Terms of Service

Welcome to Ascend. These Terms of Service ("Terms") govern your use of the Ascend mobile application and related services. By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use the app.

1. The Service

Ascend is a fitness and self-improvement app that helps you log workouts, track nutrition, monitor body composition through AI-assisted photo analysis, and build daily discipline habits. The app is provided as-is and we may add, remove, or change features at any time.

2. Account and Eligibility

You must be at least 13 years old to create an account. You are responsible for keeping your password secure and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.

3. Subscriptions (Ascend Pro)

Ascend offers an optional paid subscription called Ascend Pro with the following terms:

Available plans: Monthly and Yearly auto-renewing subscriptions.
Pricing: shown in the app at the time of purchase. Prices may vary by country.
Billing: payment is charged to your Apple ID account at confirmation of purchase.
Auto-renewal: your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
Managing or cancelling: you can manage or cancel at any time in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
Refunds: Apple handles all refunds. To request one, visit reportaproblem.apple.com.
Free trial (if offered): any unused portion of a free trial is forfeited when you purchase a subscription.

4. Acceptable Use

You agree not to:

Use the app for any unlawful purpose.
Attempt to reverse-engineer, decompile, or extract source code.
Upload abusive, harmful, or illegal content (including photos of other people without consent).
Resell, redistribute, or share access to your account.
Use the app to harass, stalk, or harm others.
Bypass rate limits, security measures, or access controls.

We may suspend or terminate accounts that violate these rules.

5. AI Analysis Disclaimer

Ascend's AI features (face scan, physique scan, food photo analysis, coach chat) are for informational and motivational purposes only. They are not medical advice, not a diagnosis, and not a substitute for a doctor, dietitian, or qualified health professional. Always consult a healthcare provider before starting a new diet, exercise program, or making decisions based on AI output.

AI results are estimates and can be inaccurate. Do not rely on Ascend for clinical decisions.

6. Health and Fitness Disclaimer

Exercise and dietary changes carry inherent risk. By using Ascend, you acknowledge that:

You are responsible for your own safety during workouts.
You should consult a physician before starting any new fitness program, especially if you have a pre-existing condition, are pregnant, or are recovering from injury.
You assume all risks associated with exercise and dietary choices.
Ascend is not liable for any injury or adverse outcome resulting from following its suggestions.

7. User Content

You retain ownership of photos, logs, and other content you put into the app ("Your Content"). You grant us a limited license to store and process Your Content solely to provide the service to you. We do not use Your Content to train AI models or sell it to anyone.

8. Intellectual Property

The Ascend name, logo, app design, and code are owned by us. You may not copy, modify, or use them without written permission.

9. Termination

You can delete your account at any time in the app under Profile → Account. We may terminate accounts that violate these Terms or for any reason with reasonable notice. Active subscriptions continue until the end of the billing period.

10. Disclaimer of Warranties

The app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the app will be uninterrupted, error-free, or that AI results will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Ascend and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or use, arising from your use of the app. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

12. Changes to These Terms

We may revise these Terms occasionally. We'll notify you of material changes through the app or by email. Continued use after the change takes effect means you accept the new Terms.

13. Apple Standard EULA

Your license to use Ascend through the App Store is also governed by the Apple End User License Agreement. To the extent that document conflicts with these Terms, these Terms control, except where Apple's EULA is mandatory.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator of Ascend resides, without regard to its conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction.
